For ListKeepr is a personal curation platform that helps users track and organize their favorite items across multiple categories including movies, books, podcasts, shows, restaurants, wine, bourbon, beer, and custom lists.

1. Acceptance of Terms

By using the ListKeepr application and website (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, you must discontinue using the Service. We reserve the right to terminate your account if you violate any provision of this agreement.

2. Description of Services

ListKeepr is a personal curation application that enables users to create, organize, and manage lists of their favorite items across various categories. The platform provides:

Core Categories: Movies, books, podcasts, TV shows, restaurants, wine, bourbon, beer, and custom user-generated lists
Organization Tools: Category-based list creation, rating systems, tagging functionality, and advanced sorting/filtering options
Data Integration:Curated information from free public sources for bourbon and wine categories, stored in our proprietary database
Affiliate Partnerships: Integration with select retail partners including Bookshop.org and Amazon.com to facilitate purchases
Personal Tracking: Consolidated taste-tracking experience across multiple interest categories

The Service is designed to replace fragmented tracking across multiple platforms with one intuitive, comprehensive solution for personal curation.

3. Eligibility

You must be at least 13 years of age to use this Service. Users between 13-17 years of age must have parental or guardian consent. By using the Service, you represent and warrant that you meet these age requirements and have the necessary authority to enter into this agreement.

4. Account Registration and Data Collection

To access the Service, you must register for an account. During registration, we collect:

First and last name
Email address
IP address
User preferences and selections
List data and ratings

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Data Storage and Privacy

User Data: All user selections, lists, ratings, and preferences are securely stored in our Supabase database
Third-Party Data: Bourbon and wine information is sourced from free public databases and stored in our proprietary system
Data Security: We implement industry-standard security measures to protect your personal information
Data Retention: Your data is retained while your account is active and for a reasonable period thereafter as outlined in our Privacy Policy

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

Engage in any illegal activity or violate any applicable laws or regulations
Use the Service to transmit harmful, malicious, or disruptive software
Interfere with or disrupt the Service’s operation, servers, or networks
Use automated tools, bots, or scripts to access or interact with the Service
Attempt to reverse engineer, decompile, or extract source code from the Service
Use content or data from the Service for training AI models without express permission
Create fake accounts or provide false information during registration
Abuse or excessively use Service features in a manner that impacts performance for other users

7. User Content and Lists

When you create lists, add ratings, reviews, or other content:

Ownership: You retain ownership of your original content
License Grant: You grant ListKeepr a limited, non-exclusive, royalty-free license to use, store, and display your content as necessary to provide the Service
Content Standards: All content must be appropriate, respectful, and comply with applicable laws
Responsibility: You are solely responsible for all content associated with your account
Removal Rights: We reserve the right to remove content that violates these Terms or is deemed inappropriate

You may not:

Post content that infringes on intellectual property rights
Share false, misleading, or defamatory information
Include personal information of others without consent
Copy, reproduce, or redistribute Service content without permission

8. Affiliate Partnerships and Purchases

ListKeepr participates in affiliate programs with select partners including Bookshop.org and Amazon.com:

Affiliate Links: The Service may contain affiliate links to partner retailers
Commissions: We may receive compensation when you make purchases through these links
No Additional Cost: Affiliate partnerships do not increase prices for users
Third-Party Terms: Purchases are subject to the retailer’s own terms and conditions
No Warranty: We do not warrant the quality, availability, or pricing of third-party products
Expanding Partnerships: Additional affiliate relationships may be added over time

9. Intellectual Property

All Service content, including software, design, text, graphics, logos, and proprietary algorithms, is owned by ListKeepr or its licensors and protected by intellectual property laws. Third-party data integrated into the Service is used in accordance with applicable terms and fair use principles.

10. Service Availability and Modifications

Service Availability: We strive to maintain Service availability but do not guarantee uninterrupted access
Modifications: We reserve the right to modify, suspend, or discontinue any aspect of the Service with reasonable notice
Updates: The Service may be updated periodically to add features, fix bugs, or improve performance

11. Account Termination

We reserve the right to terminate or suspend accounts for violations of these Terms, including:

Abusive behavior toward other users or our team
Repeated violations of acceptable use policies
Fraudulent activity or misrepresentation
Extended periods of inactivity (with advance notice)

User-Initiated Cancellation: You may cancel your account at any time through the Service interface or by contacting support. Account cancellation will result in deletion of your lists and associated data after a brief retention period.

12. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind. We specifically disclaim:

Warranties of merchantability, fitness for a particular purpose, or non-infringement
Guarantees of uninterrupted, timely, secure, or error-free operation
Accuracy or completeness of third-party data integrated into the Service
Availability or accuracy of affiliate partner information or pricing

13. Limitation of Liability

To the maximum extent permitted by law:

Our total liability for any claims related to the Service is limited to the amount you paid for the Service in the 12 months preceding the claim
We are not liable for indirect, incidental, special, or consequential damages
We are not responsible for third-party content, products, or services accessed through affiliate links
Some jurisdictions may not allow certain liability limitations, in which case limitations apply to the fullest extent permitted by law

14. Governing Law and Disputes

These Terms are governed by the laws of Illinois Any disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except for claims that may be brought in small claims court.

15. Changes to Terms

We may update these Terms periodically to reflect Service changes or legal requirements. Material changes will be communicated through the Service or via email. Continued use of the Service after changes constitutes acceptance of the updated Terms
