- Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to ListKeepr, Inc.
- Consumer, for the purpose of the CCPA/CPRA, means a natural person who is a California resident. A resident, as defined in the law, includes (1) every individual who is in the USA for other than a temporary or transitory purpose, and (2) every individual who is domiciled in the USA who is outside the USA for a temporary or transitory purpose.
- Cookies are small files that are placed on your computer, mobile device or any other device by a website, containing the details of your browsing history on that website among its many uses.
- Data Controller, for the purposes of the GDPR (General Data Protection Regulation), refers to the Company as the legal person which alone or jointly with others determines the purposes and means of the processing of Personal Data.
- Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

- Service refers to the Application, Service, Website (any or all of these services).
- Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used. For the purpose of the GDPR, Service Providers are considered Data Processors.
- Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.
- Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a session or frequency of list updates).

- Usage Information: Information about how you interact with the Service, such as features used, time spent in different sections, search queries, list creation patterns, and navigation behavior.

- Information from Third-Party Social Media Services: If you decide to register through or otherwise grant us access to a Third-Party Social Media Service we may collect Personal Data that is already associated with these Social Media accounts (such as your name and profile information).
- Location Information: General geographic location (city/region level) based on IP address, and precise location data only if explicitly permitted for restaurant recommendations.
- Affiliate Interaction Data: Information about your interaction with affiliate links and partner content, including referral tracking for commission purposes.

- To provide and maintain our Service: including enabling list creation, management, and organization across all categories, providing search and discovery functionality, and synchronizing data across multiple devices.
- To manage Your Account: to manage your registration as a user of the Service. The Personal Data you provide gives you access to different functionalities of the Service that are available to you as a registered user.
- To provide personalized recommendations: analyzing your preferences, ratings, and usage patterns to suggest new movies, books, podcasts, shows, restaurants, wines, bourbons, beers, and other items that match your tastes.
- For the performance of a contract: the development, compliance, and undertaking of the purchase contract for products, items, or services you have purchased through our affiliate partnerships or of any other contract with us through the Service.
- To contact You: to contact you by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as mobile application push notifications regarding updates or informative communications related to the functionalities, products, or contracted services, including security updates, when necessary or reasonable for their implementation.
- To manage Your requests: to attend and manage your requests to us.
- To facilitate affiliate partnerships: to track referrals to partner retailers like Bookshop.org and Amazon.com, analyze affiliate partnership effectiveness, and optimize product recommendations and placements.
- For business transfers: we may use your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by us about our Service users is among the assets transferred.
- For other purposes: we may use your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns, and to evaluate and improve our Service, products, services, marketing, and your experience.

- Service Providers: Third-party vendors who assist with Service operations, such as Supabase for database hosting, payment processing providers like Stripe, customer support platforms, and data analytics services.
- Affiliate Partners: We share limited information with our affiliate partners including Bookshop.org and Amazon.com for referral tracking and commission attribution. We do NOT share the specific contents of your personal lists, individual ratings, or detailed preferences with affiliate partners.
- Business Transfers: If we are involved in a merger, acquisition, or asset sale, your information may be transferred.
- Legal Purposes: If required by law or to protect our rights.
- With Affiliates: We may share your information with our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include our parent company and any other subsidiaries, joint venture partners, or other companies that we control or that are under common control with us.
- With Other Users: When you share personal information or otherwise interact in public areas with other users through shared lists or community features, such information may be viewed by those users and may be publicly distributed outside.

5. Data Retention
We will retain your personal information only for as long as necessary to fulfill the purposes for which it was collected or as required by law. Specifically:
- Active accounts: Data is retained while your account is active and you continue using the Service.
- Closed accounts: Personal data is deleted within 30 days of account closure, except where longer retention is required by law.
- List and curation data: Retained based on your account status and deletion preferences.
- Usage analytics: Aggregated and anonymized after 90 days for service improvement.
